Pieter's practice focuses on practical resolutions to legal disputes. There is no benefit in winning the trial if you cannot collect the judgment, or spent more to get there than you are awarded. That is why Pieter is frequently sought to act as a mediator in disputes. A reasonable settlement can be more valuable than an expensive victory.


Litigation can be the most ineffective means of dispute resolution ever devised. It is too often protracted, needlessly expensive and uncertain. One theory is that it was intentionally designed that way to force litigants to resolve their own disputes rather than leaving them to the mercy of the Courts. Under this system it is imperative to have an attorney who can maneuver through the legal quagmire, and position you for a satisfactory settlement while at the same time preparing you for a winning judgment.

Communication with clients is essential to seize every opportunity for an advantageous resolution. For this reason Pieter maintains constant communications, and makes extensive use of E-mail (pieter@bogaards.com), facsimile and telephone to correspond with clients in a responsive and immediate manner.


Pieter worked for over 13 years in San Francisco with prominent law firms before moving his practice to Marin County in 1996. He has extensive experience in corporate, litigation, real estate and employment law. His experience includes:

Employment
Representing employers and employees in employment matters, including claims for wrongful termination breach of contract and retaliation, and developing employment policies and handbooks. He has advised regarding wage and hour laws, sexual harassment claims and general compliance with California and Federal Labor laws.

Real Estate: Transactional
Consult with individuals and corporations in general business and real estate matters. Draft real estate joint venture, co-tenancy and partnership agreements. Negotiate real estate leases for landlords, tenants developers, small business tenants and commercial use lessors. Draft leases, land sales contracts, construction agreements, and general corporate documents.

Real Estate: Litigation
Broker Liability/Nondisclosure of Residential Defects.

Represent homeowners, sellers, buyers and brokers in non-disclosure and Standard of Care issues. Conduct mediation and negotiated terms of settlement for real property disputes.

Construction Defect
Responsible for every aspect of case management and trial preparation in construction defect claims. Represent contractors, homeowners and trades in addressing design and construction failures. Mediate and Arbitrate disputes to find practical remedies that can repair the defect in a reasonable manner, obtaining the "benefit of the bargain" for all parties and assuring all available insurance coverage and indemnification is recovered.
